Guardian Consent Agreement

GUARDIAN CONSENT AGREEMENT 

THIS GUARDIAN CONSENT AGREEMENT (this “Agreement), effective as of _________________, 2015, by and between [Photographer] and [Model’s Guardian] (“Guardian(s)) is made with reference to the following:

Photographer has engaged a minor, [name of minor], __________ years of age, born on ____________ [date of birth] (“Minor), pursuant to the agreement hereinabove (“Minor’s Authorization) to render services for Photographer contemplated therein (the “Project).

Guardian(s) hereby warrant(s) and represent(s) that Guardian(s) [is] [are] the legal guardian(s) of the Participant and [is] [are] responsible for the care, custody, and control of the Minor. Guardian(s) represent(s) and warrant(s) that no other person’s authorization is required to grant the rights herein, and Guardian(s) [has] [have] full authority to consent to Minor’s participation in the Project.

Guardian(s) hereby consent(s) to the execution by the Minor of the Minor’s Authorization. Guardian(s) acknowledge(s) that Guardian(s) [has] [have] read the Minor’s Authorization, are familiar with all the terms, covenants, and conditions set forth therein, have had an opportunity to consult independent legal advice regarding said Minor’s Authorization, and that Guardian(s) will not revoke said consent during the minority of the Minor. 

Guardian(s) acknowledge(s) that [he/she/they] have read, understood, and agree[s] to all of the terms, conditions, grants, and waivers contained in this Agreement. Guardian(s) understand(s) that Photographer is relying on the rights and releases conveyed under this Agreement, the loss of which by Photographer cannot readily be compensated through the awarding of monetary damages.  Guardian(s) hereby represent[s], warrant[s], and guarantee[s] that neither [he/she/they], nor the Minor, will disaffirm this Agreement at any time, whether as a minor or as an adult.

Guardian(s) hereby consent(s) to the production, distribution, exhibition, performance, and all other exploitation, including advertising and publicity, of the Product or the Finished Product as contemplated in Minor’s Authorization. Guardian(s) agree(s) to cooperate fully with Photographer by providing information, and executing documents and other instruments, as Photographer may require. 

This Agreement shall apply to the Minor’s Authorization, to all modifications and extension thereof and amendments thereto, and to any other agreement between Photographer and Minor, which may be substituted in full or in part for Minor’s Authorization. Guardian(s) agree(s) that this constitutes the entire agreement between the parties hereto with respect to all of the matters herein and its execution has not been induced by, nor do any of the parties hereto rely upon or regard as material, any representations or writings whatsoever not incorporated herein and made a part hereof. No amendment or modification hereto shall be valid unless set forth in a writing signed by both parties.

Guardian(s) agree(s) that this Agreement shall be governed by and interpreted in accordance with the law of the [Name of State] applicable to agreements made and fully to be performed therein. The parties consent to the jurisdiction of the local and federal courts of the State of [Name of State]. 

This Agreement shall inure to the benefit of, and be binding upon, the parties hereto, their respective successors, assigns, licensees, next of kin, heirs, administrators, executors, officers, and agents, as the case may be.  If any provision of this Agreement is adjudged unlawful, void, or unenforceable, in whole or in part, the remaining provisions shall continue in full force and effect. 

Guardian(s) [has] [have] carefully read this Agreement, understand(s) its contents, and [has] [have] had an opportunity to seek independent legal advice with respect to the review and advisability of entering into this Agreement.

IN WITNESS WHEREOF, the parties hereto have caused this Agreement to be duly executed and delivered as of the day and year first above written.
